RESOLVING DISPUTES IN THE FIELD OF LAND RELATIONS THROUGH MEDIATION

Abstract

The relevance of the declared topic of scientific research is determined by the peculiarities of protection of rights to land and the implementation of alternative methods of protection rights. Undoubtedly, the issue of protection of land rights under the influence of modern state processes is gaining importance. The article is aimed at defining the concept of mediation and revealing its features and advantages and disadvantages as a way of resolving disputes in land relations. The purpose of the article is to substantiate the effectiveness of using mediation as an alternative method of resolving disputes in the field of land relations. The leading methods of research are dialectical and systemic methods that allow considering the legal nature of mediation. The system method makes it possible to determine the types of mediation taking into account the categories of land disputes. In this scientific study, the advantages and disadvantages of mediation as an alternative way of resolving land disputes are determined. The stages of mediation in the field of land relations are defined. An understanding of mediation as a way of resolving a land dispute and the process of establishing business relations is offered. The theoretical value of this article lies in the study benefits of using mediation in land disputes. The practical value of this scientific study consists in distinguishing the stages of mediation aimed at the search for a mutually beneficial decision by the parties to the conflict.
