THE ISSUE OF CULTURAL HERITAGE PROTECTION

Abstract

The article examines the problems of legal regulation of the protection of national cultural heritage, in particular, the issue of preserving cultural and historical values, objects of intangible heritage, the completeness and sufficiency of preventive measures to minimize losses from enemy shelling of civil infrastructure, incl. objects of cultural heritage throughout the territory of Ukraine, recording the facts of the total destruction of immovable objects of cultural and historical monuments, acts of vandalism and cultural genocide during the military aggression of the Russian Federation, improving the legislation on the protection of cultural heritage by optimizing it and bringing it into line with international standards, in particular the Hague Convention of 1954. Historical experience proves that humanity has inherent respect for spiritual heritage, efforts to preserve cultural heritage and its perpetuation, even at the cost of life. Humanity, feeling its responsibility to the next generations since the 20th century, began to actively develop and implement general rules and recommendations for the preservation of cultural heritage. The Second World War made its adjustments, taking into account a number of international acts on the protection of cultural heritage. The fundamental regulatory act on the protection of cultural values in the event of an armed conflict is the Hague Convention of May 14, 1954, in particular the Second Protocol to it, adopted on March 26, 1999, which provides for measures to strengthen the protection of cultural values and intensify the participation of the Contracting Parties in the protection of cultural values in the event of an armed conflict Ukraine joined the II Protocol on 04/30/2020 (Law No. 585-IX dated 04/30/2020). Ukraine has joined the international acts on the protection of cultural heritage, and therefore must fulfill its obligations, first of all, to make appropriate changes to the Law of Ukraine “On the Protection of Cultural Heritage” for the national cultural heritage and to ensure the unity of Ukrainians all over the world in the protection of our identity and the state of Ukraine.
