Social Rights Protection in the Development of the Ukrainian Constitutionalism

Abstract

The article is devoted to the definition of the place of social rights in the process of theUkrainian constitutionalism evolution. The emphasis is laid on the fact that the Constitution of Ukraineproclaimed our state to be a social state, the main task of which is to achieve social progress, based on theprinciples of social equality, general solidarity and mutual responsibility, and improving the living standardsof the population. In this regard, the concept of constitutionalism and social rights, the level of theirobservance and provision are analyzed. The authors argue that social state is the state, which protects andpromotes the economic and social well-being and decent living conditions for all citizens, creates equalopportunities and equitable distribution of wealth promoting their human rights guaranteed by theconstitution. By its essence constitutionalism is the degree and breadth of perception of the basic law by eachbranch and institution of law, but not limited to it, as it determines politics, economics, social and spiritualspheres of social life.
