Legal Aspects of Agricultural Production in Mountainous Regions of Ukraine

The article examines the requirements of international law aimed at introducing the concept of sustainable development into the mountainous sector of the agrarian economy. The study has revealed the inefficiency of the national agricultural legislation decisions aimed at ensuring balanced agricultural production in the Carpathian region and puts forward the proposals on improving the regulatory framework of Ukrainian agricultural management in this area. The agricultural production in the mountainous regions of Ukraine has its own specificity owing to a number of the economic, social, demographic, natural and cultural factors. The legislative regulations of the agrarian production in the specified regions ought to take into account these specifics. Balanced mountainous farming can be maintained only when the legal acts of agrarian and land legislation are based on the concept of sustainable development. In the current legislation of Ukraine, about ten normative legal acts contain separate provisions on the state incentives for agricultural production in the mountainous regions of Ukraine, but they are mainly declarative and non-systematic. The development and consolidation in the agrarian and land legislation of Ukraine of special mechanisms for stimulating agricultural production in the mountainous regions on the basis of the concept of sustainable development requires, first of all, joining to the Protocol on Sustainable Development of Agriculture and Rural Areas to the Framework Convention for the Protection and Sustainable Development of the Carpathians (2017) and the implementation of its regulations in the national legislation, in particular, the approval of the State Target Program for the Development of Mountainous Areas of the Ukrainian Carpathians with the definition of monitoring criteria and assessment of the effectiveness of the measures envisaged by it.
