Civil-law realities of permissibility of using a smart-contract in contractual relations

The article deals with the analyses of the legal nature of the smart contract in view of the availability of grounds for the extension of the procedure for its conclusion and norms implementation of civil law of Ukraine. The comparative characterization of the smart contract and the civil law agreement are researched. Since the current legislation of Ukraine does not allow the possibility of entering into smart contracts, the main common and distinctive features of both types of contracts are outlines in the work, and the existing prerequisites for amending civil law norms are consideres. Therefore, conclusions are made on basis of the necessity of smart contract legalization as a legal (digital) form of settlement of contracts between contractors of a civil law contract. So, researched terms are definitely used in practice, and demonstrates the stable tendency to quantitative increase.
