Phenomenon of Mobbing in Managing Human Resources in Public Administration in Poland in the Judicial Protection Aspect

In the article the term «mobbing» as the newest category of labor law in the European Union and Poland is analyzed, the problems of the qualification of hindering the labor collective the hired worker to work normally as mobbing are considered. The aspects of legal protection from mobbing are founded.Five components relating to personal and professional functioning of the victim of mobbing are highlighted: actions that complicate the communication process, actions that negatively influence the implementation in society, actions that negatively influence the personal characteristics of individuals, actions that spoil the professional position of the victim; actions that negatively influence the health of the victim. The analysis of data provided by the Polish Ministry of Justice, indicates that in 2011, there were 647 claims for compensation in cases of mobbing in the district and county courts, including 535 in district courts and 112 in the county courts, which indicates the awareness of citizens’ their labor and civil rights.
