PRINCIPLE OF SUBSIDIARY AS A BALANCE OF INTERACTIONS BETWEEN INSTITUTIONS (ON THE EXAMPLE OF THE EUROPEAN UNION)

The article is devoted to highlighting the role and significance of the principle of subsidiarity as a modern principle that helps to ensure interactions and relations between institutions of different levels in complex hierarchical systems, including international or supranational ones. The coverage of the principle of subsidiarity is of particular importance due to its role in the social doctrine of the Catholic Church, which influenced the formation and promotion of fundamental ideas on the organization of church activities and, as a result, views on the modern and progressive organization of relations between institutions, organizations and groups within the state, as well as the organization of relations between states or between states and supranational institutions at the international level, which was based on the ideas of social justice and freedom to independently solve certain issues at the local level. The article examines the main provisions that establish and regulate the principle of subsidiarity within the European Union as a supranational entity in the aspect of a wide range of approaches of the modern scientists to the principle of subsidiarity as part of a complex mechanism of interaction of subjects within the horizontal and the vertical relations. In order to analyze the concept of the principle of subsidiarity, the article outlines several approaches to its definition and understanding by modern domestic and foreign scientists. In addition, the article draws attention to the understanding of this concept through the dimension of justice, harmonization of interests and the achievement of the “public good” when it is applied in global supranational entities, which is based on the issuance of the distribution of powers or competences. Drawing the attention of readers and researchers to this issue, the article emphasizes the importance of understanding of the fundamental ideas and concepts that form the basis of modern principles of administrative law, their genesis and their influence on the processes of state formation and concept of the distribution of competences in the hierarchy of institutions of different levels (in this case - the principle of subsidiarity), which, in turn, actively influence a lot of relations in the society, and as a result, the further development and potential improvement of the interactions.
