Administrative Court as a Subject of Administrative Legal Proceedings

Abstract

The subject-matter of the research is modern administrative proceedings system in Ukraine, the place and role of the administrative court in it as the main subject of these proceedings. The article presents a theoretical study of the place and role of the administrative court in the system of administrative court proceedings in Ukraine. The study of the problem confirmed that administrative court is the main subject of the administrative proceedings and has an independent administrative status. The category of «subject of administrative proceedings» is much broader in its significance and essence, than the category of «participant of administrative proceedings», since it covers not only participants but also the administrative court as a subject having administrative procedural legal subjectness. The category «participant of the administrative proceedings» is a component of the category «subject of the administrative proceedings».
