LEGAL PRINCIPLES OF VIRTUE CIVIL SERVICE IN UKRAINE

Abstract

The article proves that integrity should become the basic and fundamental principle of every Ukrainian official. The purpose of the article is a systematic analysis of the legal framework for the formation of the integrity of the civil servant in terms of the relationship between morality and law. In results, the issue of ethical and legal dimensions of civil servant integrity is closely related to the relationship and interaction of morality and law in the system of socio-normative regulation. The history of the introduction of the term “integrity” is given in the legislation of Ukraine: from the Order on approval of general rules of conduct civil servant from October 23, 2000 to the introduction of changes to Constitution of Ukraine, where integrity has become a prerequisite for work of civil servants. The authors analyzed different scientific approaches to defining the concept of “integrity” of such scientists as S. Gula, G. Gravera, G. Sukhotska, and also proposed actually own definition of the concept. It is established that the creation of a system of virtuous and professional public service in accordance with international standards is one of the main directions of implementation of the Anti-Corruption Strategy for 2020–2024 years. We believe that the issue of integrity can be considered as a concept, phenomenon or category. In any case, it is a question of values and goals in a democratic society, qualitative social changes in the ethical dimension, as well as the development of knowledge and skills. We also analyzed the results of a conference between representatives of the Supreme Court, the Council of Europe, the Venice Commission and others on ways to improve the moral principles of civil servants, and especially integrity. The investigation concluded that it was necessary adoption of a law on the protection of persons who report in good faith corruption offenses; reforming the system of public remuneration employees by significantly increasing the level of salaries; adoption of a law on inspections of public servants at integrity, in which to provide rules and procedures for such inspections, etc.
