REFORMING THE NATIONAL SYSTEM OF PUBLIC PROCUREMENT IN THE CONDITIONS OF EUROPEAN INTEGRATION AND SUSTAINABLE DEVELOPMENT: SOME ASPECTS

Abstract

The article is devoted to the study of the main directions of modern and perspective regulatory regulation of the public procurement system in Ukraine in the conditions of European integration and sustainable development. It is emphasized that the concept of sustainable development in the regulation of the national sphere of public procurement began to be implemented in the domestic legal field relatively recently. It was noted that the first comprehensive, systematic attempt to introduce this approach into relevant legislation was the adoption of the new version of the Law of Ukraine “On Public Procurement” on September 19, 2019. Separate scientific approaches to understanding the concept, content and components of the concept of sustainable development are analyzed. The economic, ecological and social components of sustainable development and their consolidation in the national procurement legislation have been studied. It is emphasized that the main array of environmental and legal provisions and norms of a social nature of Law No. 922-VIII is largely the result of the goal declared in its preamble to adapt the legislation of Ukraine to the acquis of the European Union for the implementation of the Association Agreement. It is argued that the steadfastness and consistency of the process of approximation of the national regulatory framework in the field of public procurement to the EU acquis, taking into account the concept of sustainable development, is clearly traced in the Strategy for reforming the public procurement system (“road map”). It has been proven that further reforms and development of the domestic public procurement system should be carried out taking into account the need to achieve the goals of sustainable development in accordance with existing social and environmental priorities. A conclusion was made about the need to implement the concept of sustainable development and the balance of its economic, ecological and social components in the regulatory and legal regulation of the national sphere of public procurement in the Strategy for Reforming the Public Procurement System for 2024–2026.
